Design Legal Agreements and Privacy Policy
Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used.
Non-Disclosure Agreement (NDA) for Dream Whisper clients
Dream Whisper respects your professional artwork and will only use it only to assist you in your goals. Your copyrights will remain yours. Dream Whisper will not take your custom artwork for use on any other site, resell it, or give it to anyone under any circumstance.
Logos
Dream Whisper will commence work on an order once the Client's payment has been processed. Once the Client has placed an order, a representative of Dream Whisper's Logo Design Team will contact the Client in order to confirm his/her order and method of payment.
Dream Whisper will provide the initial logo samples to our Client within 3-7 working days (depending on the chosen package). Dream Whisper will post the initial samples to a secure website, accessible only by the Client. The Client will then be able to view his/her logo samples and also be able to provide his/her feedback concerning the design of the samples.
Dream Whisper's Designers will analyze the Client's feedback and revise the samples. The revised samples will be resented to the Client within 3 working days. Dream Whisper will keep revising until Client is 100% satisfied. Each revising-circle lasts 3 working days. Once the sample has been approved by the Client, Dream Whisper will proceed with the delivery phase. All requested formats are zipped and emailed to the Client. Client shall have 60 days to respond to each set of concepts/revisions submitted to Client for review. If after 60 days the Client has failed to so respond, Dream Whisper will assume the Project complete and the Project shall be deemed to be complete.
Refunds
If Client is not satisfied with the initial concepts provided by Dream Whisper, the Client may request a refund. Dream Whisper will refund the total payment made by Client, less administrative and processing fees. Once Client requests additional revisions for any of the initial concepts, Client shall forfeit the right to the refund.
Copyright/Trademarks
The Client unconditionally guarantees that any element of text furnished to Dream Whisper for inclusion in the design samples do not infringe on any copyright or trademarks that have been already established by another organization. The Client will hold harmless, protect, and defend Dream Whisper and its subcontractors from any claim or suit arising from the use of such elements furnished by the Client.
Ownership
Ownership of the final artwork become the property of the Client, having unlimited, indefinite, and royalty-free use of the image. Dream Whisper retains the right to display the artwork in it's portfolio and advertising materials. With regards to the respective package selected, Clients are allowed to choose only one logo design, one slogan design, one business card design, one envelope design, one letter head design. All designs, concepts, slogans or other materials displayed to the Client which are not selected by the Client remain the full property of Dream Whisper. Clients can purchase additional logo designs provided within the samples created to fulfill the Client's order for $100.00.
Web Design/Programming
Website programming and design normally take several weeks, at minimum. Given the labor hours involved, we do not offer refunds on websites or any/all advanced programming performed.
If you have opted to purchase a website template through Dream Whisper, please be aware of and read the specific terms of use located on the product pages. The Client will hold harmless, protect, and defend Dream Whisper and its subcontractors from any claim or suit arising from failure to comply with the specified terms and conditions.
Marketing Materials
The creation of customized graphics (ex: Logo, Stationary, Brochure, Advertising, Packaging, Advertising Specialty etc.) takes time, patience and a high skill level. Depending on the level of the specific service ordered, the client may not have exclusive rights to a product template. With the exception of the specific policies herein, Dream Whisper does not offer refunds on any/all graphic design services performed. Though we strive to ensure that no errors have been made, we encourage clients to thoroughly evaluate their designs prior to giving final approval. Once final approval has been given for any project, Dream Whisper will not be responsible for errors contained within any design or marketing product and the client shall hold Dream Whisper harmless from any damages or liability resulting from such errors.
Setup and design fees pay for the actual labor to setup accounts, create templates, design websites, etc., and other services and as such are non-refundable. In addition, Dream Whisper will not issue refunds under any of the following circumstances:

You have given us a final approval on any design, print or marketing product, or advertising specialty item.

The party for whom the design service or marketing product was purchased closes, changes its name, or changes its activity.

The project is cancelled for reason(s) unrelated to the creative work of Dream Whisper LLC.

You fail to communicate with us regarding your purchase for 60 days or more.

You received a digital product.
Eligible refunds are subject to administrative and handling fees.
Privacy
The Information We Collect
This notice applies to all information collected or submitted on the Dream Whisper website. On some pages, you can order products, and make requests. On some pages, you can submit information about other people. For example, if you order a gift online and want it sent directly to the recipient, you will need to submit the recipient's address. The types of personal information collected at these pages are:

- Phone
- Client informational requests.
- Information regarding orders.
- Credit/Debit Information
- IP Address
- The information on referring sites by using cookies.

The Way We Use Information
We use the information you provide about yourself when placing an order only to complete that order. We do not share this information with outside parties except to the extent necessary to complete that order.
We use return email addresses to notify you about your order status. Such addresses are not used for any other purpose and are not shared with outside parties except to fulfill your order.
We use the information you provide about someone else when placing an order only to ship the product and to confirm delivery. We do not share this information with outside parties except to the extent necessary to complete that order.
We offer gift-cards by which you can personalize a product you order for another person. Information you provide to us to create a gift-card is only used for that purpose, and it is only disclosed to the person receiving the gift.
You can register with our website if you would like to receive our catalog as well as updates on our new products and services. Information you submit on our website will not be used for this purpose unless you fill out the registration form.
We use non-identifying and aggregate information to better design our website and to share with advertisers. For example, we may tell an advertiser that X number of individuals visited a certain area on our website, or that Y number of men and Z number of women filled out our registration form, but we would not disclose anything that could be used to identify those individuals.
Finally, we never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
How You Can Access or Correct Your Information
If you have set up an account with Dream Whisper by placing an order through our online shopping cart, you can access your information by logging in to your account.
You can correct factual errors in your personally identifiable information by sending us a request that credibly shows error.
To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections.
